Mother Files Wrongful Death Lawsuit Against Ex-Husband Suspecting Foul Play.

When a person dies as the result of another’s negligence, Massachusetts law permits the victim’s survivors to recover damages on behalf of their deceased loved one in a wrongful death action. The beneficiaries entitled to receive damages for a married decedent are the spouse and any children, while beneficiaries receiving damages for an unmarried decedent are the next of kin. Next of kin are most often the decedent’s parents or close siblings. Like any case based on negligence, the plaintiff must be able to prove four elements to recover in a wrongful death case. These four elements are duty, breach, causation and damages. Essentially, the decedent’s beneficiaries must prove that the defendant owed their loved one a duty, and that a breach of that duty caused the decedent’s death.

Elaine Hatfield Redwine has filed a wrongful death lawsuit against her ex-husband, Mark Redwine, following the death of their thirteen-year-old son. Their son, Dylan Redwine, had been visiting his father on a court-ordered visit on November 12, 2012, when he mysteriously disappeared. A massive search ensued, and an excruciating eighteen months later, police and search crews uncovered some of Dylan’s remains. The remains were located just three miles from Mark Redwine’s Vallecito, Colorado home on Middle Mountain. It took search crews over a year, climbing steep terrain on their hands and knees, before they located evidence of the boy’s death.

A year after the boy’s disappearance, before evidence of his death had been located, Dylan’s mother spoke out at a memorial service accusing her husband. Immediately following the disappearance, she blamed her ex-husband for the boy’s disappearance and told family and friends that she believed Mark had killed their son.

Two and a half years after her son’s partial remains were located, Dylan’s mother has filed a wrongful death lawsuit against Mark Redwine. Under Colorado law, a parent has a duty to provide proper parental care for a child. According to her lawsuit, Mark breached that duty when his actions lead to the death of their thirteen-year-old son. Elaine is also seeking damages for loss of consortium resulting from the loss of her son. She is seeking a full twelve-member jury trial. Presently, any possible criminal action is still under investigation. The Durango Herald reached out to Mark Redwine to ask about the pending lawsuit. He indicated that he had not heard of the lawsuit yet.

Boeing Sued for Wrongful Death from Defective Airbag.

Wrongful death claims involve all types of fatal accidents, ranging from complicated product liability and medical malpractice cases to simple car accidents. A wrongful death claim exists when a person dies due to the legal fault of another person. Typically, the executor or executrix of the decedent’s estate files the claim on behalf of the suffering survivors.

Last November, Ken Otto was working for an aircraft interior engineering services and Boeing supplier named Jamco America. According to a KING5-TV report, he was injured when an airbag he was working on in a parked Boeing 777 aircraft accidentally discharged. A few weeks after that accident, which occurred on the flightline near the Boeing Co.’s Everett, Washington facility, Otto died from his injuries.

Otto is survived by his wife and two sons, one of which was born four months after Otto’s death.

Otto’s family filed a wrongful death lawsuit against Boeing this past Wednesday. They claim that Boeing acted negligently by failing to properly warn Otto and his peers of the hazards of working on a defective airbag system inside the aircraft. His attorney also included another man in the suit, claiming that the other man now suffers from post-traumatic stress disorder resulting from the accident.

Lawsuit Filed One Year After Teen Is Killed In Deadly ATV Accident.

In 2010 alone, there were 590 reported deaths related to ATV accidents. That same year, it is estimated that nearly 115,000 people were treated in United States emergency rooms due to ATV-related injuries. These accidents are caused by a number of factors, including inexperience, speed, and most commonly, riding on paved roads alongside motor vehicles. ATVs are not intended to be used on the roadway. It is on paved roads that most fatal ATV accidents occur.

Nearly one year ago, sixteen-year-old Ryan Mullens was killed in a tragic ATV crash along Howe Road in Whitefield, Maine. According to local police, the ATV never should have been on the road in the first place. Ryan had been driving behind his friend’s vehicle, when he attempted to pass his friend’s car. During this maneuver, the ATV collided with the vehicle, causing Ryan to be thrown from the ATV. He later died of his injuries.

His friend, the female teenage driver of the vehicle, was never charged by police or cited for any criminal activity. Nevertheless, Ryan’s mother is filing a civil lawsuit to seek wrongful death damages. His mother, Stacey Savage, is represented by attorney Jason Jabar.

According to WGME News, if awarded damages, Ryan’s mother hopes to use part of the money to create a foundation in her son’s name. Because civil lawsuits require fault to be found only by a preponderance of the evidence, rather than beyond a reasonable doubt, the fact that no criminal charges were filed is not dispositive regarding liability in the civil suit.
