There are more motorists and vehicles on the road today than at any time in human history. That is generally a good thing, but not always. Cars, after all, are two metric tons of metal that can easily reach speeds of over sixty miles per hour. As such they are capable of inflicting tremendous bodily harm. Not only can the negligence and carelessness of a vehicle’s driver cause serious harm, but the negligence of a vehicle’s manufacturer in making a faulty car can lead to similar dire consequences. Defective vehicle components and faulty parts can significantly aggravate, and even cause, the injuries sustained in a car accident.

A Texas jury recently ordered the Ford Motor Company to pay Jennifer Garcia’s family $30.4 million in damages for its involvement in her death. Jennifer was driving with her parents in their Ford F-150. At that time, they were suddenly and violently struck by one Hazel Scaman, a passing motorist, causing their pickup truck to roll over. The force of the collision was serious enough, but making matters even worse, the Garcia’s truck’s roof collapsed when the truck rolled over. This resulted in serious brain injuries to Jennifer. She was unresponsive at the scene, and was immediately rushed to the Valley Baptist Medical Center-Harlingen, where she fell into a deep coma. After eighteen days, Jennifer died. She was only sixteen.

Arguing that the truck’s roof was defective and thereby failed to properly protect her, Jennifer’s family sued the Ford Motor Company. A jury found that Ford was 90% responsible for Jennifer’s injuries and subsequent death, and ordered them to pay her family for medical expenses and all other damages.

Imagine a warm, sunny day in South Carolina.  It’s May, and the long, hot summer is just around the corner.  You can feel it in the air.  In fact, it’s so warm outside that you and your family decide to spend the weekend on the lake.   Other people are out enjoying the weather, just like your family.  People are skiing, tubing, jet-skiing, and boating all across the water. Like any other public place, there is a reasonable expectation of safety when out on the lake.

Especially on hot summer days, these small and enclosed bodies of water are full of water bound vehicles that can cause injury if operated negligently.  This is critical for operators to understand, particularly because many watercraft do not have braking systems.  Usually, the local police patrol lakes and ponds in their jurisdiction to prevent accidents from happening.  Unfortunately, human nature sometimes finds a way to cause havoc.  Boating accidents happen in the United States every year, and sometimes are severe enough to claim the lives of innocent people.

On May 19, 2014, 26-year-old Justin Reed Walters was driving his boat on Lake Marion in South Carolina.  Eyewitnesses at the lake that day claim that an unidentifiable boat was driving at an excessively high rate of speed.  The driver apparently did not see 19-year-old Millicent McDonald riding her jet ski.  The two watercraft collided and McDonald was seriously injured.  McDonald was airlifted from the scene to a nearby Columbia hospital. She never regained consciousness, and she was pronounced brain dead less than 24 hours later.  McDonald was removed from life support and died shortly thereafter.

In the wake of this terrible tragedy, police could not initially identify the perpetrator of what is likely a crime.  But after four months of investigating, they traced the evidence at the scene and elsewhere to Walters, who has since been arrested and charged with reckless homicide by operation of a boat.

Fifty-one years after Dr. King proclaimed his dream to the world, we are still fighting against racial inequality.  From Rodney King to Trayvon Martin, African-Americans continue to feel the sting of racial profiling.  These cases, while prominent, represent a much larger issue in our country today.  In addition, incidents of police brutality have taken center stage with racial profiling, thus creating a whirlwind of public outcry for justice.

In August of 2014, 25-year-old Ezell Ford was walking on West 65th Street in south Los Angeles, California.  He was mentally ill.  At the time, he was living with his parents, Edzell and Tritobia Ford.  While he was walking down the sidewalk, Mr. Ford was approached by two Los Angeles police officers.  One of the officers was Asian-American and the other was Latino.

According to a lawsuit filed by Ford’s parents, the officers stopped him, even though he was not committing a crime.  After he complied with the officers’ requests to lie on the ground, the lawsuit alleges that they shot and killed him for resisting arrest.  Finally, the lawsuit claims that the officers knew that Mr. Ford was mentally ill and acted with gross negligence.

In addition to the two officers, the lawsuit names as defendants the City of Los Angeles and the LAPD for inadequate training of the two officers.  The Ford family has filed the wrongful death lawsuit in federal court seeking punitive damages, in addition to money damages for severe emotional distress, mental suffering and loss of enjoyment of life. They are also seeking compensatory damages for funeral costs, legal fees and expenses.  In total, the Ford family is seeking $75 million in damages.

If you have lost a loved one in an accident caused by someone’s reckless or negligent misconduct, please contact our highly skilled Boston, MA wrongful death lawyers.  Our professional and specialized attorneys will help you obtain the monetary compensation that will allow you to grieve without the fear of heavy financial burden.  Your needs are our top priority!
