Wrongful Death Lawsuit Stemming From Whitewater Rafting Accident Settles For Undisclosed Amount.

Tragic accidents occur on far too frequent a basis. When they do occur, the natural inclination is to try and understand how such a thing could have happened, and what conditions allowed it to happen. In essence, we want to know whose fault it is that an accident took place. Sometimes there is no blame to be assigned; but oftentimes, horrible accidents are the result of negligent behavior, and the accident could have been avoided altogether had someone acted reasonably. In such a situation, it would be wise to contact an expert personal injury attorney at 617-787-3700.

In the summer of 2015, Brian Niedermeyer employed the services of Geyser Whitewater Expeditions for a whitewater rafting trip on the Gallatin River, a tributary of the Missouri. According to reports, the raft flipped over, causing the guide and all seven passengers to fall into the water. After being pulled ashore and receiving CPR, Brian Niedermeyer tragically died, prompting his wife Angela to file a wrongful death lawsuit against Geyser. Among many allegations, the suit claimed that Geyser failed to properly prepare the raft for the conditions, failed to properly train its employees, and gave Mr. Niedermeyer an old and ineffective life jacket.

Although Geyser denied nearly all of the allegations, the two parties eventually settled mid-trial, for an undisclosed amount. Both parties have expressed their happiness to “have the case behind them.” Niedermeyer was represented by attorney Devlan Geddes of Goetz, Baldwin and Geddes PC.

Family Of South Carolina Woman Files Wrongful Death Lawsuit Against American Airlines, Citing Negligence Of Staff.

The most pressing concern for airlines is, of course, the safety of their planes and protecting passengers. There is not much as high-profile as a plane crash, and no company wants that kind of publicity and press. Plane crashes are, however, extremely rare, and are not the only source of liability that these companies must consider. Particularly on long, cross-country flights, there is always the chance that something could go wrong with one of the passengers. Faced with the chance of being stuck thousands of feet in the air with a distressed passenger, airlines need to be able to make decisions and act quickly.

Unfortunately, American Airlines was reportedly not able to act quickly enough to prevent a wrongful death. According to reports, when passenger Brittany Oswell became violently ill on a plane ride from Hawaii to Dallas, a doctor on board told the flight crew to inform the captain that immediate medical attention was needed, and that the plane should be diverted. However, no such diversion was made, and Brittany stopped breathing. She eventually died after three days while on life support at a local hospital in Dallas.

Now, her family is bringing a wrongful death lawsuit against American Airlines for negligently failing to take proper action that might have saved the young woman.  They are seeking damages in an amount to be determined by the jury for severe emotional distress, anxiety, grief, and sorrow. American Airlines, when reached for comment, noted that it takes the safety of its passengers incredibly seriously, and that it would be looking into the complaint. Brittany Oswell was 25 years old.

Evidence From Fatal Car Crash Involving Church Parishioners Suggests Other Party Was Texting While Driving.

Driving under the influence is universally recognized as an incredibly dangerous and foolish undertaking, and has been publicly decried by parent organizations and car companies alike. But what can be just as dangerous, and might not receive the same level of attention, is distracted driving. Instead of driving poorly due to inhibited senses, distracted drivers simply don’t pay attention to the road, and as a result fail to anticipate and compensate for the traffic around them. Distracted drivers pose a great threat to road safety, and can cause crashes all the time. In such a situation, it would be wise to contact an expert personal injury attorney at 617-787-3700.

On their way home from an annual three-day Baptist retreat, thirteen parishioners from the First Baptist Church of New Braunfels, in Texas, were killed after a car crashed into their bus. According to reports, the bus was struck by a teen who was texting while driving. Video captured by other drivers shows the teen’s car swerving and driving erratically, as these other drivers attempt to get the police to stop the driver. Unfortunately, their attempts were too late, and the driver crashed into the bus containing the church officials, resulting in a horrible crash and tragic wrongful deaths. Only one passenger on the bus survived the ordeal.
