Defendant in Massachusetts Murder Trial Elects Not to Take the Stand.

A Burlington, Massachusetts murder trial continued on September 20, 2013, when defendant Christopher Piantedosi declined the right to take the stand to testify on his own behalf. Judge Diane Kottymer told the jury that every defendant has that right, and that they should not make a decision or be influenced by the defendant’s election to exercise that right. 

Piantedosi is on trial for first-degree murder.  He allegedly stabbed his girlfriend, Kristen Pulisciano, back in May 2012.  Pulisciano died in her home on Forbes Avenue. Piantedosi pleaded not guilty. His lawyers claim that due to hospital medication, he was involuntarily intoxicated at the time of his girlfriend’s wrongful death. The prosecution called an expert witness, who was a psychiatrist for nearly 25 years. The psychiatrist testified that it would take a significantly higher dosage to involuntarily intoxicate someone, with the medication that Piantedosi was given during his hospital visit, just before his girlfriend died.

The jury is set to begin its deliberations after the closing statements scheduled to be made on Monday, September 23, 2013.

Drunk Driver Kills Grandmother, Pregnant Woman and Child in New Jersey.

A driver in Jefferson, New Jersey was involved in a fatal car crash that took the lives of a grandmother, a pregnant woman and her eleven year-old daughter.

The family was driving on Route 15 on August 24, 2013, returning home from a family barbeque.  The driver’s name is Luis Torres, from Jersey City.  There were nine passengers total in the vehicle at the time of the car accident.  Seven of the passengers were ejected upon impact. The grandmother Lucila Colon and granddaughter Tevia Booth were both pronounced dead at the scene. Julissa Colon sustained severe personal injuries and was transported to the Morristown Memorial Hospital emergency room where she and the fetus both died shortly thereafter. Torres and the remaining passengers were taken to St. Claire’s in Dover to be treated for a range of moderate to severe personal injuries.

Police say Torres told them that he was speeding on the roads he did not know very well.  He was relaying on his global positioning system due to his unfamiliarity with the area.  Torres drove too closely to another vehicle, and attempted to swerve to avoid crashing.  Due to swerving, he lost control of the vehicle, flipped and crashed it into a nearby house.  Torres’ admissions make it clear that he is a responsible driver.  He told police he was at least twice the legal limit of blood alcohol content because he was drinking beer throughout the day.  He said he smoked marijuana the day before, and brought some to the barbeque that day.

Torres was charged with multiple counts of aggravated manslaughter, vehicular homicide and assault by automobile.  He was taken to the Morris County Jail.

Bicyclist Struck And Killed On Busy San Francisco Thoroughfare.

A bicyclist, identified as 24-year-old Amelie Le Moullac,  was struck and killed by a semi-truck in a wrongful death accident in San Francisco’s South of Market neighborhood on the morning of August 14, 2013.

The San Francisco resident was struck at around 7:00 a.m. at Sixth and Folsom streets by a truck making a turn at the intersection. Following the tragic bike accident, the San Francisco Bicycle Coalition issued a statement describing the Sixth and Folsom intersection as “one of the city’s few designated bike routes to downtown — yet it is still an intimidating street, with no separation between bike riders and fast-moving traffic.” The association also called for semi-trucks in the city to be fitted with convex mirrors so truck drivers will be better able to see both bicyclists and pedestrians.

Overall, the August 14 accident is San Francisco’s third involving a bicyclist in 2013 with all three having also involved a large truck. This fact has prompted some city officials and residents to call for the city to finally move ahead with a delayed plan to redesign Folsom Street and other streets designated as bike routes.
