A King County, Washington judge has denied the defendants’ motion to dismiss a lawsuit alleging negligence in a wrongful death matter brought against the City of Seattle and two of its police officers. The wrongful death action arises out of the fatal shooting of one Charleena Lyles. The Superior Court Judge, Judge Julie Spector, rejected defendants’ request to throw out the case. The motion to dismiss was filed by attorneys for the two Seattle police officers that were involved, Officers Jason Anderson and Steven McNew, and the dismissal motion was later joined by the city.

Ms. Lyles was a 30 year-old mother of four children. She was killed in June, 2017, while in her North Seattle apartment, after she had called her local police department to report a burglary. Officers said she abruptly attacked them with a knife after they arrived on the scene. Ms. Lyles’ death sparked a number of protests. The protestors believe that the shooting was racially motivated. Ms. Lyles was African American; the officers are white.

The family of Cameron Caruthers has filed a wrongful death lawsuit against the man who shot and killed him. Jeffrey Caruthers and Allison Bradbury, the parents of Cameron Caruthers, filed the lawsuit seeking compensation of at least $25,000 and punitive damages from Ricky Gurley and the company he owns, Risk Management Investigations, LLC. Gurley shot and killed Jeffrey in May 2017 while he attempted to enter a home on Dawn Ridge Road to retrieve personal belongings from Kelsey Poore, a resident of the home.

When Jeffrey Caruthers, who had been living at the home as well entered the house, he found Gurley sitting in the living room brandishing a firearm, according to the lawsuit. The lawsuit states Caruthers “emptied his pockets and put his hands above his head and verbally told Mr. Gurley he was not armed, meant him no harm, and was only attempting to retrieve personal belongings.” Gurley then allegedly fired at near point-blank range, killing Jeffrey. The lawsuit alleges Gurley used an unreasonable amount of force, as well as unlawfully possessed a firearm. Gurley is separately charged in federal court for being a felon in possession of a firearm.

The wrongful death lawsuit was filed on January 12 on behalf of Edward Schmidt, the husband and father of the victims. Sean Woulfe, 25 years-old, faces 16 counts of reckless driving for the July 24 crash.
