The estate of a Georgetown, South Carolina man killed in a crash involving two tractor-trailers last year in Orangeburg County, South Carolina has won a settlement of $11 million in a wrongful death lawsuit. The estate of Kenneth Avis was awarded the settlement, with $6 million being allocated to the survival action and $5 million to the wrongful death action, in the U.S. District Court on July 11 of this year. Mr. Avis’s estate will receive $7.2 million, $3.9 million from the survival action and $3.3 million from the wrongful death action.

Mr. Avis, 48 years-old, died of thermal injuries sustained in the crash when his tractor-trailer collided with another tractor-trailer on South Carolina (S.C.) Highway 4, causing both vehicles to burst into flames. The collision occurred in the early morning hours of Friday, Aug. 19, 2016. Mr. Avis was driving a 2015 Volvo westbound on S.C. 4 when it struck a 2016 Freightliner being driven eastbound on Neeses Highway by David Lee Gullikson.

The family of a woman killed when a New Jersey Transit commuter train slammed into a station last year filed a wrongful death lawsuit earlier this week against the agency. Fabiola Bittar de Kroon’s family is seeking an unspecified amount of compensatory damages in the lawsuit filed in the State Superior Court in Hudson County, New Jersey.

The 34 year-old Brazilian lawyer was standing on a platform when she was killed by falling debris in the Sept. 29, 2016 crash in Hoboken, New Jersey. More than 100 people were injured in the crash. It was later revealed that the engineer suffered from sleep apnea. The lawsuit alleges that the New Jersey Transit should have implemented necessary safety technology and improvements, including positive train control. It also includes assertions that the New Jersey Transit should be held responsible for requiring only one crew member in a driving cab or locomotive during a train’s entry into the Hoboken Terminal (a two-crew member requirement has since been implemented by the agency). The suit also says the agency failed to properly and adequately screen for, monitor and treat medical issues of its enployees.

Hoboken, N.J. Train Accident Turns Deadly, Killing One And Injuring 100 People.

A New Jersey train from Hoboken crashed at the station, causing one death and injuring hundreds of people. The passengers on board did not realize the ride they were in for until the moment of the deadly accident. During this particular morning commute, the Hoboken train was going faster than usual. The incident was shortly reported all over social media and the news. Due to the crash, train service was suspended for the day. The New Jersey officials have taken precautions so this will not happen again. A bill was passed that prohibits engineers from operating a train if they have a drug or alcohol conviction.
