There is a wonderful sense of freedom that comes with riding a motorcycle: the roar of the engine between your legs, the wind rushing past you, and the rush of adrenaline are just a few examples.  This freedom does not come without its elements of risk, however, and many motorcyclists forget just how exposed they are to injury while traveling on our roads and highways.  Many collisions that would only be a minor incident in a car or truck can result is serious personal injuries on a motorcycle.

One such incident recently occurred in West Bridgewater, Massachusetts.  A fifty-six-year-old motorcyclist was run over by a dump truck.  The dump truck cut across the road the motorcyclist was traveling on, causing a collision.  The motorcyclist managed to slow down considerably and reportedly only struck the truck at about five miles per hour, but the momentum of the collision pushed the motorcyclist under the truck.  The truck driver was unable to stop in time and drove over the other man’s chest and head, killing him instantly.

The motorcyclist’s attorney, Marc Breakstone, filed a wrongful death lawsuit against the truck driver and his employer since the collision occurred during the course of the driver’s employment.  The motorcyclist’s estate argued that the driver failed to properly stop in time and that he had a “Z” restriction on his driver’s license, which reportedly prohibited the man from driving a vehicle that is not equipped with a breathalyzer interlock system.  The man’s truck had no such system.  The lawsuit was ultimately settled by all parties for $3.5 million.

There is generally a three-year statute of limitations that restricts the amount of time that an injured Massachusetts motorcycle accident victim has to settle a claim or file a lawsuit.  On April 11, 2013, Bruce Phipps was working at the Twin Hickory Station, which was a pig launching and receiving station in Tyler County, Ohio.  At approximately 7 P.M., a flash fire and explosion occurred.  Phipps was unable to escape the fire because there was not appropriate signage indicating the exits.  Phipps suffered serious burns and ultimately died at the hospital the following day.

According to wvrecord.com, Phipp’s widow filed a wrongful death lawsuit on behalf of the estate against Eureka-Hunter Pipeline LLP, Traid Hunter LLC, Transtex Hunter LLC, Magnum Hunter Resources Corp., Apex Pipeline Services Inc., Exterran Energy Solutions LP and Western Oilfields Supply Company Inc.  The lawsuit alleged that Phipp’s death could have been avoided if the defendants would have conducted their operations in a safe and reasonable manner.  The family received a settlement of close to $18 million. This settlement is believed to be one of the largest settlements in Ohio County on behalf of a single family.  Attorney Scott  Blass represented the Phipps family in this lawsuit.
