Motor vehicle accidents can change lives in a matter of a second. Every day, millions of people drive on American highways and roads. Usually, we make it to our destination safely. But sadly, that is not always the case. Car accidents can happen in the blink of an eye; when large trucks are involved in the crash, the results can be even more devastating. Accidents involving large commercial trucks are more likely to be fatal due to the massive size and sheer weight of the truck and its cargo.

The family of James McNair learned of this tragically when they lost their fun-loving relative in a fatal truck accident. McNair, a comedian who went by the name of “Jimmy Mack,” was being driven in a limo bus along with fellow-comedian, Tracy Morgan, and several other companions when the tragic accident occurred. A Walmart truck traveling at 20 mph over the speed limit rear-ended the limo bus, causing substantial injuries. According to initial reports, the Walmart truck driver was nearing his drive time limit, which may have contributed to the crash. Four plaintiffs, including McNair’s family, joined in a lawsuit against Walmart. McNair’s family was represented by lawyers at Eichen Crutchlow Zaslow & McElroy, LLP. Recently, a settlement was reached; however, the exact amount is not being released.

Riding off-road recreational vehicles is considered by many people to be a fun way to spend a weekend afternoon.  Dirt bikes and ATVs are specially equipped to handle the most rugged terrain.  In the deeply wooded areas of the country, dirt bikes and ATVs are very popular, especially among today’s youth.  However, these vehicles can also be very dangerous if they are not driven with a reasonable amount of caution.  They are not intended for travel on public roads or highways.  Moreover, like other similar types of vehicles, such as motorcycles or bicycles, dirt bikes and ATVs offer very little protection in the event of an accident.  In fact, according to the United States Consumer Product Safety Commission, nearly 51,000 children ages 5 to 14 are hurt annually riding all-terrain vehicles, mopeds and minibikes.  That number also includes traffic accidents.

On Monday, January 23, 2015, 17-year-old Aaron Gunter was riding his dirt bike along Highway 62 in Oliver Springs, Tennessee.  He had no head lights or tail lights.  At that time, Sharon Morton, 67, was driving westbound in her 2008 Kia. She was suddenly blinded by a passing car going eastbound and was unable to see Gunter as he moved up alongside her.  Ms. Morton’s car then hit Gunter’s dirt bike.  He flew off of his bike and landed on the side of the road where he was found by emergency personnel several minutes later.  Sadly, young Aaron was pronounced dead at the scene.

Dirt bike accidents are extremely dangerous events that often cause serious injuries.  In the worst of cases, they can result in a wrongful death.  If you or a loved one has been injured in a Massachusetts recreational vehicle accident, call our Boston personal injury lawyers to get a free legal consultation.  This will allow our attorneys to assess your claim and take the steps necessary to get the most damages for you and your family.  Please don’t hesitate to call us at 617-787-3700, or email us at info@gilhoylaw.com.

Under the law, many different relationships exist that require a duty of reasonable care to one or both of two separate parties. The employer-employee relationship is one of these types of relationships.  Employers are required by law to take reasonable precautions to ensure that their workers are kept safe on the job.  When that duty to protect an employee is breached, and an employee is injured or killed on the job as a result, employers may be held responsible.

One such type of employment is logging.  Logging jobs are found almost exclusively in the northern parts of the United States, where evergreen trees are plentiful.  Removing these trees may seem like a simple task, but it is far from completely safe.  Heavy machinery is required to bring down the thousand pound trees.  Each day is filled with hazards, and even the most cautious worker can fall victim to a logging accident.  Unfortunately, the statistics speak for themselves.  In 2012 alone, 81 workers in the timber industry were killed on the job, while more than triple that number were hospitalized for serious injuries.

On January 10, 2014, Erin Van Brocklin, a 41 year-old logger from Washington, was killed when a log rolled down a steep hill and crushed him to death.  At the time, Mr. Van Brocklin was employed by the B&M Logging Company.

According to the police report, Van Brocklin was working alone in a somewhat isolated area when the accident happened. The one witness to the accident was part of a crew that was preparing to move recently cut timber onto another ridgeline. That witness told police that he was helping to set up equipment when he heard Van Brocklin scream.  When first responders arrived at the heavily wooded area, Mr. Van Brocklin was already gone.  The falling log had caused major head trauma and killed him.

If you or a loved one have suffered injuries or a wrongful death at a Massachusetts logging site or construction site, you may be entitled to significant pecuniary compensation.  Call us today at 617-787-3700 to discuss the details of your case with an experienced Boston lawyer.
