The family of a Cincinnati, Ohio Carson Elementary School third-grader, who hung himself in January, have filed a federal lawsuit against school officials. The wrongful death suit claims 8 year-old Gabriel Taye’s suicide resulted from a January attack in the boys’ restroom that was caught by a school surveillance camera and that school officials allegedly covered up. The suit says that school officials “deliberately withheld vital information from his mother, including that he had been assaulted, lost consciousness for a considerable period of time, and was at risk of a serious head injury.

Defendants reportedly informed the victim’s mother only that her son had fainted in the boy’s restroom and had recovered completely. In addition, the suit claims defendant school officials not only knew that student-on-student aggression was rampant, especially in the unsupervised bathrooms, but chose to cover it up rather than alert parents and the school community so that the violence could be investigated and resolved. The wrongful death lawsuit names as defendants the Cincinnati Board of Education, since-retired Superintendent Mary Ronan, Carson School Principal Ruthenia Jackson, and Assistant Principal Jeffrey McKenzie.

The case went to the jury at 2 p.m. Monday following a six-day trial before Chatham County State Court Judge Gregory Sapp. The jury awarded $4.1 million for the full value of the life of Tommy Rogers, who was 54 years-old when he died in December 2014. The verdict included $360,000 for conscious pain and suffering and $15,000 for funeral expenses.

On the apportionment section of the verdict, the jury placed 0 percent fault on the surgeon, Dr. Bradley Heiges of Orthopedics Center, 90 percent of the fault on the nursing staff of Tattnall Hospital, and 10 percent on Dr. Joseph Hand of Tattnall Hospital, who was the attending hospitalist the night after the surgery. Mr. Rogers died of bleeding from the surgery, which could have been stopped if the surgeon had been called back soon enough. The hospital’s lawyers said it was an unrelated heart attack.
