Georgia Jury Awards $4.475 Million To Widow Whose Husband Died After Surgery.

A jury in Savannah, Georgia has awarded $4.475 million to a widow whose husband died in a Reidsville, Georgia hospital the night after spinal fusion surgery. The case went to the jury at 2 p.m. Monday following a six-day trial before Chatham County State Court Judge Gregory Sapp. The jury awarded $4.1 million for the full value of the life of Tommy Rogers, who was 54 years-old when he died in December 2014. The verdict included $360,000 for conscious pain and suffering and $15,000 for funeral expenses.

On the apportionment section of the verdict, the jury placed 0 percent fault on the surgeon, Dr. Bradley Heiges of Orthopedics Center, 90 percent of the fault on the nursing staff of Tattnall Hospital, and 10 percent on Dr. Joseph Hand of Tattnall Hospital, who was the attending hospitalist the night after the surgery. Mr. Rogers died of bleeding from the surgery, which could have been stopped if the surgeon had been called back soon enough. The hospital’s lawyers said it was an unrelated heart attack.
